Terms of Use

If you suspect your pet has eaten something harmful, or your pet is showing symptoms, contact your veterinarian or a pet poison-control service immediately. Do not delay seeking care because of anything the app tells you. Assessments may be incomplete or wrong, particularly where an item cannot be identified confidently, and the app cannot know how much your pet actually consumed.

These Terms govern your use of the Pet Toxicity Lens app and this website, provided by KineticBit Inc., a corporation incorporated under the Canada Business Corporations Act with its registered office in Ontario, Canada. By downloading, accessing, or using the app you agree to them. If you do not agree, do not use the app.

You must be at least 13 years old to create an account. If you are under 18, you may use the app only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes, subject to these Terms. We reserve all rights not expressly granted.

You can use the app as a guest or create an account. If you create one, you are responsible for the activity under it and for keeping access to your email secure, since sign-in is by one-time code to that address. Tell us promptly at support@pettoxicitylens.com if you believe someone else has access.

You can delete your account at any time from Settings → Delete account in the app, or via our account deletion page.

• Paid subscriptions are sold and billed by the App Store or Google Play, not by us, and are governed by that store’s terms as well as these.
• Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends.
• Cancel in your store’s subscription settings. Cancelling stops the next renewal; you keep access until the period you have paid for ends.
• If a free trial is offered, its length and terms are set by the store and shown to you before you confirm. Unless you cancel before the trial ends, it converts to a paid subscription.
• Refunds are handled by the store under its own policy. We cannot issue refunds for store purchases.
• Deleting your account does not cancel a store subscription.

Unlimited scanning on a paid plan is subject to a fair-use cap of 100 scans per day, which exists to prevent automated abuse.

You keep ownership of the photos, questions, and pet details you submit. You grant us a limited licence to host, transmit, and process that content solely to operate the service — to produce your assessment and show you your own history. We do not use it to train AI models. Do not submit content you have no right to submit, and do not include sensitive personal information in a scan or question.

You agree not to:

• Use the app for any unlawful purpose, or to harass, harm, or impersonate anyone.
• Reverse-engineer, decompile, scrape, or attempt to extract our reference data in bulk.
• Interfere with or disrupt the service, or circumvent any rate limit or access control.
• Resell, sublicense, or present the app’s output as your own professional advice.
• Rely on the app as a substitute for veterinary care.

The app, this website, and their content, design, and software are owned by KineticBit Inc. or its licensors and are protected by intellectual-property law. Third-party names referenced in the app — including reference-data sources — belong to their respective owners and are used to identify the source of factual information, not to imply any endorsement, certification, or partnership.

The app depends on third-party services, and it is distributed through the App Store and Google Play. Those stores are not responsible for the app or its content.

For the iOS app specifically: these Terms are between you and KineticBit Inc., not Apple. Apple has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

The app is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that assessments will be accurate or complete, that identification will succeed, or that the service will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the fullest extent permitted by law, KineticBit Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of or inability to use the app — including any decision made or not made in reliance on an assessment. Our total aggregate liability is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $50. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

You agree to indemnify and hold harmless KineticBit Inc. and its officers, directors, and employees from any claim or demand, including reasonable legal fees, arising from your misuse of the app, your breach of these Terms, or your violation of any law or third-party right.

You may stop using the app and delete your account at any time. We may suspend or terminate access if you breach these Terms or if we must do so for legal or security reasons. On termination, your data is handled as described in the Privacy Policy. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnity, and governing law — do survive.

We may update these Terms. We revise the “last updated” date at the top of this page, and for changes that materially affect your rights we will give notice in the app at least 30 days before they take effect. Continuing to use the app after that means you accept the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You and KineticBit Inc. submit to the exclusive jurisdiction of the courts of Ontario, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.
